Terms of Service

The agreement, in plain words.

Last updated: July 2026

These terms govern your use of Forget-Me-Not, at forgetmenotmemorial.com. We've tried to write them the way we write everything here — plainly, and with respect for the fact that you're probably here during a hard time. By creating a memorial, adding a memory, or placing an order, you agree to these terms. If you don't agree, please don't use the service.

This page works alongside our Privacy Policy, which explains how we handle what you share.

Who can use Forget-Me-Not

You need to be at least 18 to host a memorial or place an order. Anyone can view a memorial they've been given the link to, and anyone can add a memory — no account is required to contribute.

Your account

Hosts sign in with a secure link we email — there are no passwords. Keep access to your email account safe, since anyone with your sign-in link can manage your memorial. You're responsible for what happens under your account. If you believe someone else has gained access, contact us and we'll help.

The memories and photos you add

You keep ownership of everything you contribute — your written memories, photos, and videos remain yours. We don't claim to own them, and we never sell them.

To provide the service, you give us permission to do the ordinary things a memorial requires: to store your content, display it on the memorial page and slideshow, include it in a keepsake book if one is ordered, and create backups. This permission lasts only as long as we host the content, and exists only so the service can work. When content is deleted, this permission ends.

By adding content, you confirm that you have the right to share it — that the photos are yours to post, and that what you add doesn't break the law or someone else's rights.

The host's role

Each memorial has a host who acts as its caretaker. The host can feature, hide, reorder, or remove contributions, and controls whether the memorial is public or unlisted and whether it appears in search engines. Hosts should honor the spirit of each contribution — the words people share are gifts, not to be silently rewritten.

What isn't allowed

Please don't use Forget-Me-Not to post content that is unlawful, hateful, harassing, threatening, or infringing on someone else's rights; to impersonate someone; to upload malware or attempt to break or overload the service; or to collect others' information for spam. A memorial is a place of remembrance — treat it that way.

Content we may remove

We'd rather never step in, but we reserve the right to remove content, or suspend a memorial or account, if something is unlawful or abusive or violates these terms. If you see something that shouldn't be here, tell us and we'll act quickly.

Keepsake orders, pricing, and payment

Creating a memorial and collecting memories is free, and always will be. The optional keepsake — a digital book and a printed hardcover — is our paid product. Current prices are shown on the pricing page and at checkout; printed books are priced by length. Prices may change over time, but the price you see at checkout is the price you pay for that order.

Payments are processed by Stripe. We never see or store your card number. Printed books are produced and shipped through our print partner. Printed books currently ship within the United States; if you're elsewhere, write to us and we'll see what we can do.

Printing, delivery, and reprints

Because each book is printed on demand from what's on the memorial at the time you order, please review the book before ordering. Digital books are delivered by email. Printed books are produced and shipped after payment; production and delivery times are estimates, not guarantees, and can vary.

If a printed book arrives damaged or with a printing defect, reply to your confirmation email and we'll arrange a free reprint. Because the books are personalized and made to order, we can't accept returns for change of mind, but if something isn't right, tell us — a person will make it right.

Keeping your memories

Hosts can download everything — every photo and memory — as a family archive, free, at any time. The memorial page stays online and, after a long quiet period, settles into a lightweight archived version rather than disappearing. We may adjust how long full-resolution originals are kept, but your downloadable archive means your memories never depend on us alone. We recommend keeping your own copy.

Availability

We work to keep Forget-Me-Not running and dependable, but we provide the service "as is" and can't promise it will always be available or error-free. We may update, change, or occasionally take parts of the service offline for maintenance.

Our responsibility, and its limits

We care deeply about this service, but to the fullest extent the law allows, Forget-Me-Not is provided without warranties of any kind, and we aren't liable for indirect or consequential losses. Where we are found liable, our total liability to you is limited to the amount you paid us in the twelve months before the claim. Some places don't allow certain limitations, so parts of this may not apply to you.

Your responsibility to us

If content you post, or your misuse of the service, causes a claim against us, you agree to cover the reasonable costs that result — the ordinary trade-off for being able to publish freely on a platform you don't own.

Changes to these terms

If we change these terms in a way that matters, we'll update the date at the top and, for significant changes, let hosts know. Continuing to use the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the United States and the state in which Forget-Me-Not operates, without regard to conflict-of-laws rules. Any dispute will be handled in the courts located there.
